1. General

Protecting your privacy is an important matter for us. The following data protection statement applies to the use of the website belonging to Walde Immobilien AG. By using our website, you consent to the data protection statement. Our website is subject to the Swiss Federal Act on Data Protection (FADP) and complies with the key elements of the European Union (EU) General Data Protection Regulation (GDPR).

In principle, it is possible to use our website without providing any personal data. However, if you wish to make use of particular services offered by Walde Immobilien on our website, it may be necessary to process personal data. Your personal data will be collected and processed with the greatest possible care.

Walde Immobilien makes every effort to ensure the security of your data within the scope of the applicable data protection legislation and technical capabilities. We use the SSL (Secure Sockets Layer) encryption system. However, we wish to point out that the transfer of data via the internet using e-mail communications is subject to security vulnerabilities.

For the remainder of this document, the company will be referred to using the abbreviated forms “Walde Immobilien”, “Walde” or “we”. Accordingly, possessive pronouns will be used in relation to the website (e.g. “our website” etc.). The term “website” shall be used to encompass all webpages, web subpages and website functions that collect user data.

Within this data protection statement, the use of “they” as a singular pronoun shall be used to include people of all genders and in order to ease readability.

2. Collecting and processing personal data

We may collect your personal data (e.g. first name, surname, company name, address, e-mail, etc.; cf. section 3), data on your online preferences and our corresponding services. You have the option of registering for various services on the website by providing personal data (e.g. by completing a contact form to request documentation). The nature of the data to be transferred to Walde will usually be set out on the input mask in question. We use and store the personal data collected from you in communications with you, to conclude and carry out transactions, for market research, for marketing and to carry out our business practices. This also includes forwarding your data to owners whose properties have not been successfully marketed or sold and for which you have received sales documents (proof of interest in sales mandates).

Your personal data will be stored only as far and for as long as it is required to provide our services or it is stipulated by law. If you create an account with us, your personal data entered here shall be stored indefinitely. You can request to delete your account at any time (cf. section 5). Personal data will be deleted, provided that Walde has no statutory obligation to store it.  When ordering sales documents, you explicitly declare that your personal data may remain stored until the conclusion of a sales mandate in the event of proof of interest. However, this shall be limited to the duration of the statutory storage period, at the latest.

3. Data collected directly by Walde Immobilien

When you use our website and the associated services, we may collect the following personal data:

Contact details

Your data will be collected using software provided by third parties (e.g. customer relationship management or customer management programs) or imported from such software. Suitable property listings may be identified manually or automatically using a software program. You may be informed about these property listings by e-mail, post or telephone.

You may choose to opt out of this service at any time.

Property search profile

You have the option to create a property search profile. The purpose of a property search profile is to inform us of your preferences with regard to the property you are looking for. You can find out what personal data will be transferred when you create a search profile from the input mask used for this purpose. The personal data collected when drawing up a property search profile is used solely to provide personalised information about suitable property listings. The data transferred may be gathered manually in a third-party software program or imported from such a program.

If there are property listings that match your search criteria, we may inform you of these by e-mail, post or telephone. We may also ask you to update your personal data in your property search profile at regular intervals. You have the option to delete your own property search profile at any time.

Subscribing to the newsletter

You can subscribe to various newsletters from our company using either a form or e-mail. Registration is required for this, during which your e-mail address will be collected. By registering, you consent to the processing of the entered data, in particular for the purpose of regularly sending out newsletters, as well as for evaluating usage behaviour and improving our services.

You have the option of unsubscribing from the various newsletters at any time. You can adjust your newsletter settings using the link included at the bottom of all our newsletters. If this link is missing, please let us know by e-mailing datenschutz@walde.ch.

Our newsletter may contain a tracking pixel. A tracking pixel is a miniature embedded graphic that allows a log file to be traced and analysed. This makes it possible to evaluate the success or failure of online marketing campaigns on the basis of statistical data. The analysis can be done anonymously or by making inferences with regard to personal data.

Our website

When visiting www.walde.ch, our servers temporarily store the access in a log file. Then, without your action, it is possible to collect and store the IP address of the requesting computer, the website from which you accessed that belonging to Walde Immobilien, the date and time of access, the name and URL of the retrieved file and the country from which you are accessing the website. This data will be collected and used to enable use of our website, optimise our offer on system security and stability and for internal purposes (cf. section 4).

Cookies

We may place cookies and similar technologies in certain cases. Cookies allow the information and offers on our website to be optimised for the user. Cookies allow us to recognise users returning to our website. The purpose of this recognition is to make it easier for users to operate our website.

You can prevent our website from placing cookies on your computer or device at any time by adjusting your internet browser settings accordingly, thus permanently preventing cookies from being placed (opt out).

Sometimes, and insofar as permitted, we also incorporate visible and invisible image elements into our newsletters and other marketing e-mails. By calling these up on our server, we can determine if and when you opened the e-mail, meaning that we can measure and better understand how you use our offers and then tailor them to you. You can stop this in your e-mail program.

Google Analytics

We use Google Analytics on our websites. Google Analytics is a web analysis service by Google LLC.

The web analysis includes anonymously gathering, compiling and evaluating data on the behaviour of website users (e.g. which website a user came from to reach our website, which subpages are accessed, and how often and for how long a page is viewed). In order to record this information, Google Analytics uses permanent cookies, among other things. As mentioned above, you can prevent cookies from being placed by our website at any time by adjusting your internet browser settings accordingly.

The service provider will not receive any personal data from us (and will not store IP addresses), but it can track your website use, combine this information with data from other websites that you have visited and are also tracked by the service provider and then use these findings for its own purposes (e.g. managing advertisements). If you are registered with the service provider itself, the service provider will also recognise you. Your personal data will then be processed by the service provider under their responsibility and in accordance with their data protection provisions. The service provider shares with us only how our respective website is being used (no information about you personally).

Google Maps

We use an interface with geo-specific data from Google LLC in order to display location-based information. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Storing your IP address is necessary to use Google Maps functions. This information is generally transferred to a Google server and stored there. Walde has no influence on this data transfer. Google reCAPTCHA

Our website uses Google reCAPTCHA belonging to Google LLC. Google reCAPTCHA is a security query service that serves to recognise and differentiate between data entries by people and computer programs. It also works to avoid the delivery of unwanted information. For this purpose, Google reCAPTCHA analyses user behaviour on the website using various criteria. This analysis begins automatically, as soon as the user accesses our website. When entering data, the user is then prompted to answer a security question. For the analysis, Google reCAPTCHA evaluates various pieces of information (e.g. IP address, length of the website user’s stay on the website or the user’s mouse movements). The data collected for analysis will be forwarded to Google LLC. The Google LLC data privacy guidelines provide information on how they collect, process and use personal data.

Hotjar

Hotjar is an analysis and feedback service that analyses the behaviour of and feedback from users of our website. The web analysis service statistically analyses user data (e.g. which website a user came from to reach our website, which subpages are accessed, and how often and for how long a page is viewed), through which we can improve our website. The online feedback service allows users to give feedback on a website. Hotjar places tracking codes and cookies to record and collect this information.

Script libraries

We use script and font libraries (e.g. Google Web Fonts) in order to display content correctly. Retrieving a script or font library will result in a connection being made to the library provider. It is possible that the operator of the library concerned may collect and store the relevant connection data.

Social media plug-ins

Social media plug-ins from various social media network providers (e.g. Facebook, LinkedIn) may be used on our website. This will be made clear to you. Through these plug-ins, information from the social media networks concerned, potentially including personal data, can be used. If the data subject is logged into a social media network when they visit our website, it should be assumed that personal data will be transferred. We have no influence over what data is transferred in these circumstances. We do not record any personal data using social media plug-ins. The data privacy guidelines for the social networks concerned provide information on how they collect, process and use personal data.

We have configured these elements so that they are deactivated by default. If you activate them (by clicking), the operator of the social network concerned can register that you were on our website and where exactly and can use this information for their purposes. Your personal data will then be processed by the operator under their responsibility and in accordance with their data protection provisions. We do not receive any information about you from them.

Wüest Appraisal

With just a few clicks, users of our website can carry out a short valuation of their property. The data entered will be transferred to Wüest Appraisal to establish the short valuation. Wüest Appraisal stores and processes the data. In addition, the data will be transferred to Walde Immobilien. The data will be deleted as soon as it is no longer being used for the purpose for which it was collected or the user asserts a request for deletion. Wüest Appraisal also uses the user data for market and opinion research. For this purpose, Wüest Appraisal uses the data exclusively in an anonymised form and only for statistical purposes.

Immozins AG

Immozins AG operates in the field of developing, carrying out and marketing real estate projects with the aim of offering investors long-term and personal investment solutions.

We support Immozins in marketing specific new build projects. Our marketing channels include our newsletter, our website and specific project websites. In the event of particular interest in these new build projects, users can submit their contact details for further information. This data, which can be collected through these channels, may be forwarded to Immozins. This website’s data privacy guidelines provide information on how they collect, process and use personal data.

YouTube

YouTube is an internet video platform that allows video publishers to upload video clips for free and other users to also view, rate and comment on these for free. The provider is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA (“YouTube”). YouTube, LLC is a subsidiary of Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA. YouTube components are integrated into our website. By accessing property videos on this website, the internet browser on the data subject’s IT system automatically prompts the YouTube components to download a YouTube video. If the data subject is logged into YouTube at the same time, YouTube recognises which subpage the person has called up by accessing the video. YouTube and Google collect this information and link it to the data subject. The YouTube data privacy provisions provide information on how they collect, process and use personal data.
